Welcome to Bim Bargains.

Bim Bargains is operated by Blue Cottage Holdings Inc., Barbados.

These Terms of Use govern access to and use of the Bim Bargains website, mobile application, web application and related services.

By accessing or using Bim Bargains, you agree to these Terms.

1. About Bim Bargains

Bim Bargains is a platform designed to help users discover deals, discounts, promotions, offers and participating businesses across Barbados.

Businesses may use the platform to create profiles, promote offers, publish deals and access merchant features based on their selected plan.

Bim Bargains does not manufacture, supply or directly provide the goods or services advertised by participating merchants unless specifically stated otherwise.

2. User Accounts

Some features may require an account.

Users are responsible for:

  • providing accurate information

  • keeping login details secure

  • protecting passwords and account access

  • notifying Bim Bargains of suspected unauthorized use

Users may not create accounts using false, misleading or fraudulent information.

3. Merchant Accounts

Businesses using Bim Bargains are responsible for ensuring that all information they submit is accurate and lawful.

This includes:

  • business information

  • contact details

  • prices

  • discounts

  • promotions

  • deal conditions

  • availability

  • images

  • descriptions

  • expiry dates

  • redemption requirements

Merchants must honour valid offers they publish in accordance with the terms displayed to users.

Bim Bargains may review, approve, reject, edit, suspend or remove merchant content where reasonably necessary.

4. Deals and Promotions

Deals and promotions shown on Bim Bargains are provided by participating merchants.

Unless otherwise stated:

  • offers may be subject to availability

  • offers may have expiry dates

  • quantities may be limited

  • merchant-specific terms may apply

  • prices and availability may change

Users should review the full terms of an offer before making a purchase or visiting a business.

Bim Bargains does not guarantee that every advertised offer will remain available at all times.

5. Merchant Subscription Plans

Bim Bargains may offer paid merchant subscription plans.

Current merchant plans may include Basic, Pro and Premium options, with different features, limits and promotional tools.

Plan pricing, features and limits may change from time to time.

Where changes affect an active paid subscription, reasonable notice may be provided where required.

6. Founding Merchant Offer

Bim Bargains may offer a limited Founding Merchant promotion to selected businesses.

Where offered, the current introductory structure may include:

  • first month free

  • second month at 50% of the selected plan price

  • full plan pricing from the third month onward

Founding Merchant availability is limited and subject to approval.

Founding Merchant status does not guarantee permanent discounted pricing.

Additional terms shown during merchant onboarding or plan selection may apply.

7. Payments

Where merchant payments are enabled, payments may be processed through independent banks, payment gateways, app stores or other payment providers.

By purchasing a paid plan, the merchant agrees to the price and billing terms displayed at the time of purchase.

Bim Bargains may suspend paid merchant features where payment is unsuccessful, overdue or cancelled, subject to applicable terms.

Payment processing may also be governed by the terms of the applicable third-party payment provider.

8. Coupons and QR Offers

Some merchants may provide digital coupons, QR offers or other redeemable promotions.

Coupons may be subject to:

  • expiry dates

  • redemption limits

  • one-time use conditions

  • participating locations

  • specific purchase requirements

  • merchant-specific restrictions

Merchants are responsible for honouring valid coupons in accordance with the terms displayed.

Users may not duplicate, manipulate, resell, falsify or otherwise misuse digital coupons or QR codes.

9. Acceptable Use

Users and merchants must not use Bim Bargains to:

  • commit fraud

  • impersonate another person or business

  • submit false or misleading information

  • upload illegal or harmful content

  • interfere with the operation or security of the platform

  • attempt unauthorized access to accounts, systems or databases

  • distribute malware or malicious code

  • manipulate deal, coupon or analytics systems

  • misuse promotional features

  • scrape, copy or extract platform data for unauthorized commercial use

Bim Bargains may suspend or terminate accounts that violate these Terms.

10. Merchant Content

Merchants retain ownership of content they submit to Bim Bargains.

By uploading content, merchants give Bim Bargains permission to use, display, reproduce, resize, format and promote that content as reasonably necessary to operate and market the Bim Bargains platform and the merchant's advertised offers.

Merchants confirm that they have the right to use any logos, photographs, trademarks, text or other material they upload.

11. Bim Bargains Content

The Bim Bargains name, logo, branding, design, software, platform features and original content are owned by or licensed to Blue Cottage Holdings Inc.

Users may not reproduce, copy, modify or commercially exploit Bim Bargains intellectual property without permission.

12. Third-Party Businesses and Services

Bim Bargains connects users with independent businesses.

Bim Bargains is not responsible for:

  • the quality of goods or services provided by merchants

  • merchant customer service

  • merchant operating hours

  • merchant fulfilment

  • product availability

  • warranties

  • refunds provided by merchants

  • health, safety or suitability of third-party goods or services

Any transaction between a user and a merchant is primarily between those parties.

13. Reviews, Feedback and Communications

Where users are permitted to submit feedback, reports or other communications, such content must be honest, lawful and respectful.

Bim Bargains may remove content that is abusive, fraudulent, defamatory, misleading, irrelevant or otherwise inappropriate.

14. Availability of the Platform

We aim to keep Bim Bargains available and functioning reliably, but uninterrupted access cannot be guaranteed.

The platform may occasionally be unavailable due to:

  • maintenance

  • updates

  • technical issues

  • internet or hosting failures

  • third-party service outages

  • security incidents

  • circumstances outside our reasonable control

Features may also be updated, modified or discontinued from time to time.

15. Limitation of Liability

To the extent permitted by applicable law, Bim Bargains and Blue Cottage Holdings Inc. will not be liable for indirect, incidental or consequential losses arising from use of the platform or from transactions with participating merchants.

Bim Bargains does not guarantee:

  • the accuracy of every merchant listing

  • the availability of every advertised deal

  • uninterrupted platform operation

  • specific sales results for merchants

  • specific savings or financial outcomes for users

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

16. Suspension and Termination

Bim Bargains may suspend or terminate access where reasonably necessary, including where:

  • these Terms are violated

  • fraudulent activity is suspected

  • payments remain unresolved

  • platform security is threatened

  • illegal activity is suspected

  • a merchant repeatedly publishes misleading offers

Users or merchants may also stop using Bim Bargains at any time.

17. Privacy

Use of Bim Bargains is also governed by our Privacy Policy.

Users should review the Privacy Policy to understand how personal information may be collected, used and protected.

18. Changes to These Terms

We may update these Terms from time to time as the platform, services or legal requirements change.

The latest effective date will appear at the top of this page.

Continued use of Bim Bargains after updated Terms take effect may constitute acceptance of the revised Terms where permitted by law.

19. Governing Law

These Terms are governed by the laws of Barbados.

Any disputes arising from the use of Bim Bargains will be subject to the applicable laws and courts of Barbados, unless otherwise required by law.
